The North Carolina Child Abuse General Statutes state that a person is legally regarded a child when they are under 16 years of age. The District Attorney will allege a case of child abuse when there is evidence of a parent child relationship and the State believes an injury occurred that was caused by this relationship. Child abuse can also be charged if the State believes that the parent created such a situation that an injury would be substantially likely to occur or did occur.
Child abuse can be charged as a misdemeanor or felony. A felony will be filed when the State alleges that a serious bodily injury resulted.
